Trump was under investigation when he nominated Gorsuch. I didn’t hear Booker making this argument back then.

Why would the court get involved anyhow? It is clear that Mueller cannot indict him as President. The remedy to deal with any issue Constitutionally would be Impeachment, Conviction by the Senate and then you could indict.
