The legality of this was never tested in the courts. If Biden tries this it will likely end up being decided by the Supreme Court.

Treason. All of the treasonous criminals that have been spying on and been attempting overthrown a duly elected President need to be in jail for life or on the gallows on every TV and Cable Channel live.

He may be pardoned, but I am not sure that would protect him from adverse action under UCMJ.
