Constitutional rights or no it shouldn’t take 25 years to bring someone to trial. Lindsey Clancy may go through 2 trials in the span of a handful of years.

I don’t see how judges have mucked everything up on KSM anyway. He is a damn enemy combatant. He is a terrorist. Stop with the bleeding heart stuff already. At this rate they may just give him time served and let him go.

You would think the prosecution of anyone involved in 9/11 would be a layup. Our government is that pitiful I guess.

Like I said, I’m not attempting to justify anything. 25 years is indeed a shite show of a criminal matter, whether it be a case of a single Tylenol 3 of which one was found in possession without a prescription (yes, Schedule III felony crime in most states,) OR a case of murder……far too long.

But again, there are at least some things to think about. For instance, I was reading about basically the entire court staff (however many “frontline” prosecutors are assigned to the case, same with court-appointed defense lawyers, court reporters, judge, judge’s staff, yadda yadda have to assemble and fly together, as I understand it, to Guantanamo - for each and all hearing or motion needing to be heard and argued. Getting all those people available at the same time, having to go to that extent - well, I can only assume it greatly “stretches out” the court calendaring process in this case.

Then additionally the complexity and number of motions that are guaranteed to be filed in a case like this, then the trial judge’s ruling on a single one of those many motions will likely be appealed by one side or the other, everything on pause until that’s fully resolved, and so on and so on. Yes, it’s a shite show and nightmare, and as I understand it mostly at the feet of Obama for making a unilateral decision that the matter would be tried at Guantanamo instead of stateside in Manhattan, I believe it could have been. Would have been much, much more expeditious that way. Could have had one or two or however many necessary court dates available per month to resolve all pretrial issues and push to trial, as opposed to probably once every 4 or 5 or more months, on top of the availability and travel issues for all that staff.

Well one thing about American jurisprudence is you are guaranteed the right to a speedy trial. Send everyone down for a few months and get it over with. 25 yrs to prosecute a mass murdering terrorist is absurd even for the US Government.

And people want the government in charge of major things like healthcare. They are not capable of taking one of the biggest butchers in American history to trial in a timely fashion. Yet people want them in charge of things like healthcare lol.

Request would have had nothing to do with it. He should have gotten a speedy trial whether he wanted one or not and got it over with years and years ago.
