This just buys the feds couple of days to file an appeal. It doesn’t overturn the lower court.

Just a stay pending disposition of the appeal. It's not a ruling on the merits.

What are you taking about? He held press conferences, gave a televised speech and filed this lawsuit.

A man of action if I've ever seen one!

If the 9th rules against an activist liberal judge it should be an automatic removal of that judge.

What shocked me was the District Judge suspended the order and allowed time for Trump to appeal.

This is how it should be. Too much abuse of the standard of “irreparable harm”.
These are hollow victories, if victories at all.

Why not dismiss the case out of hand? Many times these judges are just giving stays and saying present your evidence in 5 days; sometimes, in this case, suspension and time to appeal.

But this case should have been dismissed. Oh, but we have to have due process they scream. Oh, but he's a dictator so the administration must prove it to a judge that he's not so we need a hearing.

So, a state's AG & governor has the right to even challenge the federal's executive to federalize and then control the national guard? This is even a question requiring evidence. Voter fraud is no standing, no hearing, GTFO out of my courtroom- oh, and we are disbarring you.

But the challenge to presidential authority over the military of the US is in question for one of 600 something federal district judges?
