If the victim was developing dyspnea prior to the officer's display of brutality, then the prosecution now has to establish that he would still be alive if the incident had not occurred.

If they can't, and this was a cardiac episode that was exacerbated but not exclusively engendered, by the act of the officer, then it would seem to favor the defense.

Cops probably should have assessed his health condition at that point and probably had a duty to administer aid to a person in their custody and control at that point. Kinda makes the next things that happened even a little more egregious in some respects.

This can be an act or a failure to act that can incriminate them.

Wouldn’t it be something if he was COVID positive as well

I started a thread earlier about him OD'n on fentanyl.

He was foaming at the mouth, pissed himself, couldn't sit still, couldn't breathe. All before he was restrained.

Dat ninja was dead before the cops showed up.

Right, but all the defense has to do is put some doubt into the jurors. The hard part will be finding any jurors that haven't already convicted him.
