This is not accurate. The 5th said in a panel decision on July 2 that illegals have a Constitutional right to a bond hearing within 90 days while their removal case is pending. The 5th then sua sponte vacated the decision and took the case up en banc on July 10.

All this order yesterday did was say that the government's en banc petition was denied as moot, and that the panel decision was stayed pending the en banc rehearing.

Now they may very well ultimately rule that way, but that isn't what happened yesterday.

ETA: The 5th is one of only 2 circuits to hold that there isn't a statutory basis for a bond hearing, and the only other circuit to rule on the Constitutional issue is the 6th and they held there is a right to a bond hearing. So far they are very much in the minority but SCOTUS will clarify soon enough.
