Remove whatever funding source he is using from your account. 
And call XBL support, I guess.

I know two ppl who has had this happen recently...
Ms will freeze the account and take 60 days to deal with it
Or
Call your bank and dispute the charges, then change your xbl password.

eta:just hung up with microsoft, case has been opened and account suspended. the dude changed everything except my billing information, naturally. he even changed my gamertag.
so do i have to start over with MW3? if so, that really sucks, but at least i can try to get a better K/D ratio this time.

What will happen is that they will investigate the charges, and if they find there was indeed a hack then they should change the gamer-tag back and remove charges. I would think you would retain all of your stats.

This guy wasn't hacked. Cracked or phished, sure, but any system that requires authentication can be cracked or phished.
So yes only psn gets hacked
Jk btw, Xbox live was hacked before my time actually...2007ish or 2006 I think
