But can the mere possession of that 10.5 barrel as well as all of the other pieces required to assemble the gun be construed as intent to assemble an sbr? That is where the interpretation comes into play. To me the ATF is nothing to play with so I would say I don't want to mess with it and chance that they would slam me with intent to build the sbr. Aparantly prop and a lot of other people on this board don't believe that to be enough to be charged with intent to build an sbr that is their choice.

That's why I think you would be in the clear if you had a pistol lower or pistol buffer tube so that you could claim intent to build pistol but if you don't posses such pistol lower but had plenty of other regular old lowers you could technically be slammed with intent. Whether or not you would ever be is another story but technically you could.

Tough if it is merely parts, including a 10.5 barrel. That's why the examples I used were complete uppers. It gets tougher to explain why you have 1 rifle (no stamp) lower and an upper in your car and the only thing keeping you from having an illegal SBR is the fact they're disassembled. Ditto for my 4 and 4 example.
But there is a shite ton of legal things you can do with a 10.5" barrel, as Prop has suggested.
Look - you do what you want to do baw. You want to err on the side of caution, wait for your stamp. We're not going to persuade you the other way, so this is academic navel gazing of the worst kind.
