Side-by-Side Title/Registration

A few weeks ago, I posted a question here about buying a UTV from a guy who didn't have the title in his hand, but could get a new cert of origin from his dealer. Here's an update now...I still have a dilemma in getting registered/titled in my name though.

I bought the UTV from the original owner in LA, who bought it from a dealer in MS. The guy never got it titled when he bought it. He stuck it on his farm in MS, then brought it to LA a few months ago when he sold his farm. We wrote up a bill of sale and had it notarized.

He reached out to the dealer in MS that day and had them order a cert of origin. I just received that in the mail yesterday from the dealer. Here's my problem though, it has the dealer's name on the front as the distributor. On the back, they went ahead and signed on the dealer line and everything else is blank. I did not buy it originally from the dealership. I bought it from the guy who originally bought it, but his name is nowhere on the title.

What do I need to do here to get it registered in my name? I have the cert. of origin, I have the notarized bill of sale for my purchase, and I have the original invoice from the guy when he bought it at dealer. It feels like I'm kind of in purgatory here...like I need the cert of origin to first be recorded in the original owner's name, then transferred to me. Or, I need an invoice from the dealership for the sale in my name. Any other way?

SxS don't have titles. They are treated just like a John Deere tractor. If you have a Cert of Origin and a bill of sale you should be good to go. I don't think you need to do anything else. That's also why the dang things get stolen so much.

This is not correct, I have a SXS and I have a title. Some people don't register to avoid paying taxes on them and they may not receive a title. I bought one used and I have one, I still need to transfer it to my name.

is it true in LA you have to have insurance on a SxS?

I guess there could be some variance by state. I'm in the Miz we don't title them, even if you have a lien on it. The lender files a UCC-1 Financing Statement at the Sec of State in order to have a valid lien, just like a piece of farm equipment.

To be even weirder a regular ATV 4 wheeler does have a title, just like a car.

There's no way the dealer is going to change whose name is on the original purchase. They'd be committing some pretty serious fraud if they did.

Is there any mention of financing on the original invoice? One of the biggest question marks I would have if someone couldn't produce a title would be that the vehicle has a lein on it. The title in the owners name is the proof that the vehicle is owned by the seller and not a financial institution.

The original invoice from the dealer to original buyer shows zero balance owed and payment via cash and personal checks. No lien or financing mentioned anywhere.

That's good. However there's no assurance that the vehicle wasn't used as collateral at a later date to secure a loan. Like I said the title is proof that the vehicle is owned by the owner. I'm always hesitant about title-less vehicles. It's a little different in the sxs/atv market but still enough money on the line to cover yourself.

What was the reasoning for not having a title in the first place? I may be wrong , but if he paid cash he should have received the title.

I've been assuming this is a newer, valuable sxs. Is that correct? We're not talking about a parts bike or anything.

Said if the dealer sent him one it probably went to an old address. I spoke to dealer personally before I bought and apparently he's a regular customer for them. MS doesn't require them to be titled/registered, so he never thought about it until I asked

It is a 2019 Ranger Crew XP 1000 20 yr anniversary edition with 750 miles. For my own peace of mind, I'd like it titled in my name. Just trying to figure out what else I need to make it happen.

Super shady IMO. Basically they are circumventing the the original buyer so he doesnt have to pay sales tax and cut him a break. In Louisiana we have to submit a DMV report every month on all vehicles sales and taxes collected so customers don't get around paying sales tax like the guy you are buying it from is doing.

If the MSO is not made out to him on the 1st assignment then the BOS between you 2 is not worth anything. You would need a BOS from the dealer, but the problem again is you didnt buy it from them. Once again, super shady if they do that and I personally don't think a dealer would do that.

Simplest way to get this deal done is to tell the seller to man up and pay his taxes

I'm not worried about having to do that. He has told me he will. My question is do I have to have him first officially title in it his name to do that?
