question about school gun free zones

I always have my gun with me and get nervous going through the school speed zones. I know you're not supposed to bring a gun on any campus but what about driving through the school speed zones and a cop pulls you over for whatever reason?

The school doesn't own that part of the road so your good. Always a good measure to let the cop know you have a firearm on or near you though. But no they can't arrest you or whatever for that

Don't pull in the parking lot of school and you will be fine. when i used to take my kids to school it was in truck but i never got out of carpool line.

I think you are protected by Louisiana state law that as long as the gun is enclosed entirely inside the vehicle it is a constitutionally protected right

It can be in your car.
Here you go
quote:
C. The provisions of this Section shall not apply to:
quote:.
(5) Any constitutionally protected activity which cannot be regulated by the state, such as a firearm contained entirely within a motor vehicle
Here you go

I believe you can have it in your vehicle, it just can't come outside of your vehicle

I wish someone with proof could say if this applies to private yet publicly accessible parking lots. I argued with the safety guy of a well known local contractor about the legality of this in the parking lot of a plant recently (contractor lot outside the gates). He was very adamant about it being illegal to have it in the truck in the parking lot, I disagreed but didn't need to lose the contract over it.

Do they have random car searches or something? I'm not understanding why you would tell the security guard that you have a gun

C. The provisions of this Section shall not apply to:
(1) A federal law enforcement officer or a Louisiana-commissioned state or local Post Certified law enforcement officer who is authorized to carry a firearm.
(2) A school official or employee acting during the normal course of his employment or a student acting under the direction of such school official or employee.
(3) Any person having the written permission of the principal or as provided in R.S. 17:3361.1.
(4) The possession of a firearm occurring within one thousand feet of school property and entirely on private property, or entirely within a private residence, or in accordance with a concealed handgun permit issued pursuant to R.S. 40:1379.1 or 1379.3.
(5) Any constitutionally protected activity which cannot be regulated by the state, such as a firearm contained entirely within a motor vehicle.
(6) Any student carrying a firearm to or from a class, in which he is duly enrolled, that requires the use of the firearm in the class.
(7) A student enrolled or participating in an activity requiring the use of a firearm including but not limited to any ROTC function under the authorization of a university.
(8) A student who possesses a firearm in his dormitory room or while going to or from his vehicle or any other person with permission of the administration.
The two bolded sections are what address your questions
If you have a concealed carry permit it can be on you inside your vehicle. If you don't have a carry permit, you can still have it in your vehicle...
Where I would like some clarification is the definition of "contained entirely". To me, that could mean that as long as it's inside the vehicle it's considered contained, correct (in other words you can't have your windows down and be pointing it out the windows)? Or does that mean it needs to be concealed inside a compartment or container/case inside the vehicle?

What are you talking about? I answered the question that a person can have a firearm in their car.

Not sure about LA but in Texas the outside lot is fine. If the lot is gated it is up to the plant, but if it is not it is up to you.
It was explained to me as anytime you "breach" a perimeter barrier (go through a door, go through a gate, etc.) you enter private property. If you don't breach you are not on property they control.

Those are separate exceptions which are numbered as such.

No, you didn't, but be was just relaying info from the statute.
Provision #5 in my post above directly answers your question.
Yes, as long as it is contained completely inside your vehicle, you can have a firearm in your car.
