I had a case in Natty where a Johnsongrass specific herbicide in corn forced the Johnsongrass insect pests onto the corn, resulting in diminished corn crop. Represented DuPont. Whitaker granted a MSJ on Federal preemption, if you can believe that.

I walked this property with two men from Providence Engineering about seven years ago. The Army Corps approved their findings which was a few acres of 100% wetlands and mostly the balance 38% wetlands.

This property was owned by my grandfather and there are 26 of us with undivided interests at this time. A large majority of my cousins decided to put it up for sale. I think that they are having the JD reapproved at this time.

Indeed it is a cool place. Many years ago started learning plant and animal taxonomy, fire arms safety, and to drive an automobile when I was eleven years old.

As to a geographical reference that you can most likely identify with, it is an eighty acre parcel located south of Maplewood area of Sulfur. The zoning designation is "light industrial."

Sounds like the Bayou D'Inde area...

That would definitely be one of those interesting areas to see how the Corps would handle it under the new rule. Given that they were still calling rice fields jurisdictional after Sackett, I'd suspect they'd still exercise some authority over the wetlands there. Even without "clear" guidance, it should have been obvious to everyone that rice fields don't maintain a continuous surface connection to relatively permanent waters.

Not too far away. Bayou D'Inde Pass Road south of the building where the Calcasieu Parish voting machines are stored.
