As to what the bank would have to say, the bank would have no recourse against the guy that owned the land. Just the guy that borrowed the money.

the latest update... from page 13

"Here's the update everyone has been waiting for. The guy called me finally Tuesday night - really it would have been 1am Wednesday morning ET. I don't know if he wanted to dick with me or what, but since I'm on PT it was only 10. He acted like you would expect. First he cussed & threatened, then he begged & talked about how everyone was out to get him & life is a big conspiracy. Pretty typical. I told him he wasn't going to get it back acting like that. So finally he layered up & his lawyer called to negotiate with me.
Long story short, he paid us & we dropped the lien. He came to my dad's place at a prearranged time with someone to get his truck. The Sheriff's office met him there & let him retrieve his truck then they took him in to custody.
So the first part of the story is over. Now we are pressing charges for the trespassing portion, & the sheriff is going after him for fleeing the officer plus original warrants. I haven't heard about the hunting violation side.

What did I learn? If this had gone to court I don't think we dotted our i's or crossed our t's enough for it to stand. We were lucky that it was never going to court because of his outstanding issues. Some have pointed out they wouldn't advise folks to do this. I agree, it's not an easy row to hoe & there are liability issues I'm sure I don't come close to understanding. However, if confronted with the same situation again & being much more knowledgeable about the process I would do this again with a close attention to detail. "
