BP's 25 Mile Limit from Coast for Claims

Not sure if anyone else has heard this but BP has told me (Baton Rouge seafood business owner affected by the spill) that all claims outside of their line (25 miles from the coast) will be denied and do not fit their criteria for claims. This is going to leave a lot of businesses hurt by this spill in south Louisiana. Will be interesting how this plays out with the Escrow program.

Has anyone else heard of this? Seems like a crazy distance requirement and an easy way of getting out of paying claims.

You heard this directly from BP? I know a charter fisherman on the northshore who is getting paid.

Cost of seafood might be high, but its not like you can't get any shrimp, or crabs. Drago's in NOLA is getting oyster out of Texas.....

Yes I did. Have been dealing with them for 2.5 months now and they have been giving me the run around and have finally given me an answer in the last week and the final answer today.

Let's see, I have been in the seafood business since I was born. Shrimp, oysters and crabs were/are at an all time high. Oysters have pretty much doubled. Yes you can get them now (since a few areas have opened up and the texas season have opened up) but shucked meat have risen 40-50% costwise. Try to double your oyster prices on your menu in a bad economy. People won't pay it. Same with shrimp. Shrimp have risen almost by $1.50-$2/lb. Crabs are risen over 50% cost wise compared to last year. All of this is not a good combination in a bad economy where sales are hard to get anyway. On top of that we wholesaled product also and when your normal suppliers are shut down and supply is low new companies are not taking on new suppliers. And to top all this off, people are scared to buy seafood like they would in a regular year. You have no idea how many times we have had to explain where our seafood came from and how it is safe. There are a lot of factors at work here that is hurting businesses.

I was in a seafood restaurant on the northshore tonight and the place was nearly empty. Usually on a Friday night you have to wait in line.

I don't disagree with you that its difficult to run a business when cost have basically doubled, but have you looked into other alternatives?
Have you checked out importerd shrimp?
Do you have a diverse menu, or is it only seafood?
Food prices sky rocketed in 2008, what did you do then?

Well then it is time to get creative, The LA coastline is a dynamic structure that never truly stops, I mean think about it, the gulf opens into the rigolets, which opens into ponchatratin, then maurapaus, and the amite river, you are well within 25 miles from the amite so I feel you are within 25 miles from the coast. keep fighting them

Yes I have. That was an option that I didn't want to go to. But you cannot sell imported fresh shrimp. Fresh shrimp was a big part of our sales. Also, most imported shrimp are farm-raised and farm raised do not tend to boil well. They are usually hard to peel when boiled.

Being that I have a seafood market & deli, I don't think I could diversify my menu without changing my name somehow. All most 100% of our sales come from seafood with most of that being fresh seafood and then cooked seafood second. And being that we also wholesale on a small level (local shrimp, local oysters, and local crab), it took out our sales on the wholesale level.

I didn't have a restaurant in 2008 but I was working in the seafood wholesale industry. Seafood prices did not skyrocket then. It was some of the other stuff that skyrocketed which really did not affect us as much. Sales got harder though due to rising restaurant costs. My restaurant started in 2009.

I tried the whole lake thing. Told them Baton Rouge is close to the lake Ponchatrain and the adjustor mentioned it to his boss (a local in Houma) and he said that is not the coast. I am going to ask for a map of the coast outlining BP's mileage limits and see what they say.

Jason, I'm not a lawyer (and I don't even play one on TV), but the first thing that jumps out at me is the 25-mile limit. Why "25", and not 24, or 26, or 24,901 miles? Seems to be arbitrary; if they provably damaged you, they damaged you no matter where you are.

This would be a good question for you to call in to WWL's Sunday morning "All Things Legal" show (8a-10a, 870am, WWL.com, 866-889-0870). No connection other than I enjoy listening to law-talk programs.

As the wife of a rice and crawfish farmer, thank you for hopefully choosing to NOT go overseas ... no, crawfish weren't affected but it is part of the LA economy and these farmers work hard to produce a great product. THANK you for choosing local/as local as possible.
