Pretty sure the statutes here and in a lot of states for a crime like that against an elementary school child can carry the death penalty, but the supreme court specifically against Louisiana ruled it as cruel and unusual punishment, hence unconstitutional.
Basically they said that only crimes that resulted in a death can receive the death penalty. I don't agree and feel that hurting a child in that manner is worse than murder. And Louisiana rarely carriers out the sentence anyway
