When restaurants automatically add tip, are there legal limits?

I'm still in Miami and we tried this new place yesterday and they make you pay with one of those devices at the table which alone is shady enough bc they didn't tell us tip was included and I tipped the only option 18% which ended up being an extra tip on top of the 23% tip they apparently already included....that just doesn't seem right to add a tip that big,can you just add whatever you want as a business owner without disclosing it?

You don't check your receipt? Go back and ask for the extra tip money back.

Technically I think the argument is that it is your choice to patronize the business. Since its a private business they can essentially add whatever they want to the bill, as long as it is either stated somewhere in the building or on the itemized check.

They don't give you one they email it to you and by the time they sent it to me I was gone. They make you pay on an iPad like device

When yiu sign those little devices I've alway seen that you can adjust the tip up or down by sliding the screen.
18% is pretty normal if it's a group of 6 or more and sometimes at places in heavy tourist areas will do it for everyone

No the 18% option was the only option for extra tip after the 23% was automatically included but you don't see that you just see total + would you like to tip

Did you read the small print on the menu? Serious question because I've been to places in Miami many times and it's usually listed on the menu
A hell of a lot safer than giving your card to the waitress and them writing down your information. Many restaurants in Latin/South America use these same practices

It's some new spot on Lincoln road there is no menu it's this New fast food spot kinda like chipotle you order at the bar off the chalkboard and they bring it to you. Miami lots of places add tip bc foreigners don't tip,I just feel 20% or more is a tad ridiculous.$7.95 tip included on a sub $35 tab and then being sneaky and just letting people add extra tip?

The only thing they can say is "pay better attention" next time. I have been to places that have the devices at the table, but I am not sure if it was required to pay there or not, but for some reason I remember seeing before hand that gratuity was included.
I can see how someone could miss it, but now you know.. And you don't round up on a tip? You can give them that extra $0.05 and make it $8.

No the $7.95 was what they automatically added and I pushed 18% on the machine and that ended up as a double tip

Funny because foreigners aren't expected to tip in Latin American countries.
Odds are the owners are old white people with no Latin heritage. I know guy that could handle this for you for a small fee

Ya I mean Lincoln road has some of the highest rents in the country and businesses are sneaky but adding an auto tip for a person to bring your burrito out is fine just don't make it over 20% and then ask for extra tip on your checkout device. It's a new place I imagine there will be some angry yelpers shortly

So you just signed this magical device without ANY clue about how much you were signing for? Or is it that with all your financial dealings and all of the things that you do, you had no idea that your bill was 8 bucks off?...or 23%?

We ordered 2 plates and the wife ordered an appetizer I wasn't paying attention to her appetizer only costing $3 I figured it was a normally priced plate and $40+ for 2 plates and an appetizer weren't ridiculous sounding in my head,I wouldn't have even noticed if they didn't email me a receipt.
