It is 100% the fault of the executioner.

There is a reason he is indicted for murder. The crime being committed didn't warrant his weapon to be drawn, much less shot into the guys head from point blank range.

If the victim was simply arrested for his actions, that would be his fault. He should have no reasonable expectation to be executed for the things he did.

He pulled the gun AFTER he didn't obey the command.

This is why it's his fault. No, the guy shouldn't have been killed, but he was because of his own actions, causing the LOE to make a mistake and use excessive force. However, it all began with the guy not obeying the officer.

He sure as hell didn't drag the officer down the street like the cop claimed. Video completely different from both officers story.

Not really. Sometimes I'll cut up a small fish to use as bait... like an hour later it's mouth will still be opening and closing. I imagine if fish had hands they could probably start a car after you killed them.

do you know why he had it out? Can you tell us for how long he had it unholstered?

Nahh,didn't think so.
We can speculate.
My speculation is that he saw the perps right hand go towards the front of the console where the ignition switch was. I'm thinking the cop thought he may have been reaching for a weapon and the cop unholstered his weapon at that time.

No. And maybe he was planning to elude the officer, but the car was still in place, until after he had been shot. I'm just pointing out the stupidity in post-hoc justification due to his eluding when the car never moved until he was presumably dead.
