Louisiana Revised Statutes - Title 14
Revised Statutes 14:29 - Homicide
quote:
§29. Homicide Homicide is the killing of a human being by the act, procurement, or culpable omission of another. Criminal homicide is of five grades:
(1) First degree murder.
(2) Second degree murder.
(3) Manslaughter.
(4) Negligent homicide.
(5) Vehicular homicide.
It looks like Manslaughter will be the best fit for this incident.
Revised Statutes - 14:31 - Manslaughter
quote:
§31. Manslaughter
A. Manslaughter is:
(1) A homicide which would be murder under either Article 30 (first degree murder) or Article 30.1 (second degree murder), but the offense is committed in sudden passion or heat of blood immediately caused by provocation sufficient to deprive an average person of his self-control and cool reflection. Provocation shall not reduce a homicide to manslaughter if the jury finds that the offender's blood had actually cooled, or that an average person's blood would have cooled, at the time the offense was committed; or
(2) A homicide committed, without any intent to cause death or great bodily harm.
(a) When the offender is engaged in the perpetration or attempted perpetration of any felony not enumerated in Article 30 or 30.1, or of any intentional misdemeanor directly affecting the person; or
(b) When the offender is resisting lawful arrest by means, or in a manner, not inherently dangerous, and the circumstances are such that the killing would not be murder under Article 30 or 30.1.
B. Whoever commits manslaughter shall be imprisoned at hard labor for not more than forty years. However, if the victim killed was under the age of ten years, the offender shall be imprisoned at hard labor, without benefit of probation or suspension of sentence, for not less than ten years nor more than forty years.
If you guys want to bloviate, at least check out what Louisiana considers to fall under homicide.

Makes sense. Get money today. Can use gift credit card as a credit card. Checks usually take 48 hours to clear, so he would have until Tuesday to make the money and cover.
Though, kinda sad to be a business man and not have enough to cover $600.

do they even still have Rite Aid? Haven't seen one in a while. CVS sucks too, a tree has to die everytime they print out a receipt. Have to fold it a dozen times to get it in my pocket.

You’re assuming he always open carries. He’ll have to back that up with more than just a self serving statement.
LOL, no he won't. There is no burden to be inspected or keep a log.

If he can’t produce other witnesses stating they see him carrying his gun all the time then he’s full of shite and this guy planned it out.
Laughably ridiculous statement. You're now arguing premeditated murder? I can't take you seriously any longer.
quote:
How long has he owned this gun? How many times has he shot it? Had he ever thought of killing his neighbor before? Why did he have these thoughts? Why did he think he needed to shot the neighbor this time if he always open carries? Oh he snapped? Why did he snap?
You make this too easy.
- For x years
- More often than police officers shoot their service weapons
- No
- N/A
- He was being assaulted by someone that had terrorized him, and others, for years. BigCorpse had done unspeakable things to the defendant and in this instance BigCorpse said he was about to kill defendant and while spraying him in the face made a move toward the vehicle, defendant feared for his life, BigCorpse got what he deserved. Use your imagination. The defense attorney will find a way to act it all out in court.
- See above.
- See above.
Hopefully you're the prosecutor. It'll be even easier for the defense.

I mean at least in Credit. I'm OT poor and have daily expenses especially in parts over that amount.
He charged me $200 for a $155 tow one time because he couldn't make change.

If falls more in line with second degree but manslaughter is what he will end up having to plead guilty to

Walgreens = Bonnabel and Vets
CVS = across from Hurricanes and Mugz's
Rite-Aid = Big Lots parking lot by Legacy
The CVS is all old people, and they are only open like 8 hrs a day. I go to C&S for meds, and Walgreens for random shite

No. It's clearly a scam.
I was going to ask "how could a grown arse man NOT see the signs of a scam", but I guess I was too quick to judge.
