Do you see anything in that video that would justify moving straight from verbal command to ASR without first attempting either soft or hard hands on restraint? I don’t, which is the reasoning behind my position. But if I’m missing something that you’re seeing, I don’t mind being corrected

That’s not how the use of force continuum works. You don’t get to skip levels simply because you tried previous levels a bunch of times. There has to be some exigency to jump levels, and I just don’t see one here.

“Hard hands” (assuming you are substituting this for “closed hand”) isn’t even in the progression for 99% of the agencies in this country, anymore. After a lawful command is issued, soft hands OR chemical agent is the next step…and, with a crowd, chemical agent is almost always the preferred.

No, hard and soft were modifying “hands on” restraint. Some manuals refer to it as open hand. Baton Rouge’s does not, which is the general order I’m most familiar with. As you say, closed hand isn’t on BRPD’s continuum.
It would surprise me to hear that any department places open hand restraint and ASR on the same level of the continuum. If you have any examples, I would be interested to see them. Further, I would be interested to see how the crowd escalation you’ve seen is framed, because it would surprise me to hear that ASR would be authorized simply as a dispersal tactic against a fairly loose group like we saw in the video without ever attempting hands on restraint.
Speaking of the video, when I watched it again just before this post, I noticed something I hadn’t before, and now I think I know why it was hard cut where it was: the officer starts moving backwards just before using ASR. I have a sneaking suspicion he’s walking away. If I’m correct in that interpretation, any fine distinctions you and I might be inclined to make go out the window pretty quickly in favor of a “yeah, definitely not a reasonable use of force and now we are probably tacking on a couple of other violations as well” territory.
But I would curious if you view those last moments the way I do.

If tweet fails to load, click here. Found a slightly longer video, and yeah… I would be genuinely shocked to see any manual/order that would justify the use of ASR in that circumstance. That deployment of ASR served no purpose in either dispersal or restraint. The officer was likely frustrated and wanted to punish her for it.
