That is why you cash them out when you leave or roll it over to an IRA in your name if possible.

Uncle Sam May take a cut, but at least you still will have your money.

I love the saying that if you are not at your old job, then your 401k shouldn’t be either.

For your 401K My belief is that someone can be put into Jail for messing with your 401K. Bankrupt or not. The only money they can not give is the last payment.

OT Lawyers opinion?

But if the 401k is heavily funded with stocks from the bankrupt employer then essentially you now have worthless stock in the 401k without anyone touching it.

Hence my point. Never leave money where you can’t touch it or know what is going on.

This is exactly what happened...luckily it wasn’t a lot of money. the stock tanked shortly after I left, and I always thought it would come back up...it didn’t.
