How far from your house are you talking? Have you considered getting someone out to quote the repair job and then pass that onto the HOA with a letter from your lawyer?

You need to talk to an attorney asap. There are statutes of limitations on filing lawsuits once problems are known I think. For the record, I am not an attorney.

I bet your HOA wouldn't let you go 2 years on an infraction in the bylaws. They would serve you with an injunction quickly and expect you to comply immediately. The same should be done in this situation. Have your lawyer send a strongly worded letter asking them to have a plan to get it fixed within 30 days and start the project within 60 or you will be filing suit, thats what they would do.
