So many holes in this case

This is literally the only hole in the story that you've mentioned.

Why didn't they call 911? Aside from the fact that it's totally irrelevant to the situation, maybe they just panicked. I mean, they were both shot, and their buddy had a bullet in his neck. But sure, Seth Fontenot is the one who got a "raw deal."

Who gave them beer is, again, totally irrelevant to the situation.

Why not question the girlfriend? My understanding is there was no need. All she could have said was whether or not she heard people outside. Did she testify for the defense?

Depends on what other charges the jury was given to hand out in case they couldn't all come to a 1st degree murder conviction vote.

Was he ever charged with 1st degree murder? I thought it was 2nd degree, not that it really matters in LA.

Can you explain the reason why there is not much of a distinction between 1st and 2nd degree murder in LA? This has confused me for years.

He was charged with 1st degree, found guilty of manslaughter. The jury was allowed to consider a lesser charge if they found him not guilty of the original charge.

This guy deserves to go to jail for a while. You can't just shoot at people you think might have committed a crime.

it doesn't matter if they were the ones stealing from his car that night, or any prior night. they were fleeing, and placing him in no threat of harm. you can't kill someone for a property crime.

he might get manslaughter for killing someone in the heat of passion, but he will get convicted of some serious felony.

Hopefully.

I am pretty sure that is what state law allows. Whether its dumb or not is not the point. Make dumb votes, you elect dumb politicians......

I don't have an opinion either way. If you commit any kind of murder, manslaughter....you need to go to jail for a long time. I don't think whether you meant to or not is up for debate....

I agree, but I think the prosecutor should have to prove the case he brought forth. Not whiff on it and then get bailed out by the jury.

You know, that prosecutor was pretty confident that he was guilty of first degree, even though absolutely nobody agreed. Except maybe the parents of the dead kid, but that is just par for the course there. I really don't believe he thought he'd have the jury consider lesser charges until the end of trial. Problem is, either way, he got what he deserved, which is what he would have likely plead to had it been offered.
