questions about fightng a ticket

Totally hypothetical situation here, but let's say you got a ticket for not stopping at a stop sign. Would the ticket not being legible be a good defense? Like if the writing were so light you could barely read it, would that be a problem?

Let's also say the code listed on the ticket is not the same as the code listed in the municipal code. Would that be a problem too?

What if the amount of the ticket is also for more than the municipal code calls for? Do cops have leeway when making up the fine? If there are no other charges, is it ok to charge more? What if there were also no other vehicles or pedestrians in the intersection?

Again this is a purely hypothetical situation. Just something I was thinking about.

A ticket is simply a summons to appear in lieu of arrest. The State can prosecute you for whatever they'd like, as long as they can prove their case.

In short, no, ticket technicalities don't matter.

Just do the diversion program and stop complaining that “hypothetical you” got caught rolling a stop sign. It’s not as big of a deal as you are making it.

Cops arrest my clients on nonsensical bullshite all the time, because the average cop knows just enough about the law to get themselves in trouble. State cleans it up afterwards with their billing decision.

If you want to create a hard rule that someone can only be prosecuted for exactly what police cite them for, I'm all fricking for it
