They have judges on call to sign warrants for blood tests so whether you blow or not is not what it used to be. They will likely get you with a blood test

First of all don't drink and drive. Pay what ever it takes to keep that DUI off your record. Having one can keep you from getting jobs or even going to certain countries.

No you are. I never said you couldn't do Pre Trial Diversion if you refuse to blow. Show me where I said that.

I'm just pointing out the law is against you, and most numbnutts don't see the possible consequences of refusing to blow, and think it's the obviuos choice.

You are left to the mercy of the DA. You yourself just said "IF the DA accepts."

What if he doesn't?

because you do not have to have 1 sip of alcohol to be charged with DUI, if a cop suspects that you have been drinking everything that you do will be looked at under that light of suspicion and you do not want to give them anything that will assist them

Exactly. The best thing you can do is stfu and not incriminate yourself. I’ve been hemmed up for dwi twice. There won’t be a third time.

But the laws are complicated people will read my previous sentence and think I’ve been convicted for two but that’s not how it works at all.

Best case scenario is that they offer him pre trial diversion and he gets to spend the next year being a puppet for the city. It's going to cost about $10,000 when it's all said and done. 1 year of monthly drug tests and a breathalyzer in his car. Community service. Mad mothers meetings. Therapy. Group counseling. Monthly meetings with the person who runs the pre trial program. It's not fun, but when he finishes, the charges will go away and you can get them expunged.

So much bullshite here. It all depends on the county/parish.

In lafourche if you are pulled over (first instance not first offense) fir dui and blow between .08 and .15 you are looking at a 6 month suspension I believe on your lic. That’s from the dmv. If you want to take a chance and ride under suspension that’s on you but the dmv isn’t tracking you down to get a breathalyzer.

Secondly, you go talk to the prosecutor and get into the pti program. 32 hours community service. One 10 hour class. A fine between 750-1100. Unsupervised probation. Once you complete all the requirements of the pti which is not much you get it tossed with no conviction. But this maybe the most important thing. Take those court minutes of no conviction to the dmv. Because they will still have some shite in your license.

When I did this it was only a 3 month suspension. I just rolled the dice and after three months went to the dmv. Said I wanted my license back. They gave me one as if I had lost it. Didn’t even pay the reinstatement fee.


Unless your doing some reckless shite you won’t sniff close to 10000 in money spent.

This is your get out of jail free card for a dwi. Generally you can’t do pti twice in the same parish. Now if you get popped a second time that is what the court views as a first and the penalties are much of the same as what I said above. The only difference is this time I got the blow machine which is costly because you gotta recalibrate the cock sucker every month. Still haven’t spent close to 10000.

10k to not go through a year of not being able to drink, or leave the county without permission, sounds pretty worth it to me.

I will take 6 months of a hardship license over 2 years of having to pay fines, blow into an interlock, get permission to leave the county, and can’t drink.
Which is what’s gonna happen if you don’t go the blood test route.
The lawyer can, for the last time, possibly get the suspension completely wiped out.
It’s your choice though.

You meant to say the lawyer can charge you out the nose and will most likely lose the suspension issue. You make it sound like an automatic win.

What the hell arguments do you think Perry Mason is gonna make to automatically beat it?

Sure it does happen, but if you got stopped for drunk driving, there's likely probable cause.
