In a private conversation.

I think it's ok in Louisiana. 1 person must be aware of the recording. Amirite?

A lawyer and cop once told me that in the state of LA only one person has to know a conversation is being recorded but they have to be part of that conversation.
I don't think you can stand in a corner and record someone with spy gear or some shite and it be used.

This was brought up recently in a thread about people recording their house showing.
In LA, the law appeared to be that someone engaged in the conversation had to have knowledge of the recording. So if you want to record your conversation with someone else, go for it. You can't legally record to unsuspecting parties.
*I am not a lawyer and I didn't look this shite up, just going off of memory from that other thread.

Need to know more about the situation in question.

It's depends on the state and the nature of the recording, i.e., in person, telephone, etc.

Audio?
A 3rd party can not record a 2 party conversation without consent. One party of a 2 party conversation can record the conversation they are engaged in without receiving consent

It was ok to secretly record that Clippers owner and hold him accountable for having an opinion in his own home.
