OT Lawyers: Is it cruel and unusual punishment if the felon chooses it?

Example: Say standard sentencing for a crime is 6 months-1 year in prison.

They could do their time, or elect to be publicly flogged 20 times, where it would open wounds on their back and they would need medical care afterwards....but 5k in medical bills is better than 25k in housing them for 6 months.

Does cruel and unusual allow for choice, if not who decides what is defined as cruel.
