The delay can be at least partially attributed to our litigious society. If the trigger numbers (on paper) are not actually met by the river, and the Corp opens the gates and the land floods, an attorney will have a field day. (regardless of the flooded land being in a designated FLOODway)

The ACoE recently got their arse handed to them in a lawsuit from farmers in Iowa or Missiouri, can't remember. They were found to have made flooding worse through changes designed to protect a bird or fish or something. I forget the details.

St. Louis Public Radio - Landowners win lawsuit against Army Corps of Engineers for Missouri River flood damage (March 14, 2018 article)

quote:

A group of 372 farmers, landowners and business owners in several Midwestern states filed suit against the Corps of Engineers in March 2014, alleging that the federal agency's actions contributed to five floods along the Missouri River since 2007. Senior Judge Nancy Firestone ruled on Tuesday that the Corps of Engineers was liable for damages caused by recurring floods.

In 2004, the agency began prioritizing wildlife protection and restoration over flood control. The Corps of Engineers' changes to its management practices, which included "reopening historic chutes" and "increased reservoir stage and threatened and endangered species releases," caused riverbanks to erode and contributed to the inundation of private properties, according to the judge's ruling.

"We've said all along that this river has changed, and it's changed as a result of the management of the river by the Corps of Engineers," said Roger Ideker, the lead plaintiff in the lawsuit.

Sorry to derail, but with this discussion, I was wondering if anything ever came about with the city of Walker wanting to sue the state for the way I-12 was modified? They had put a barrier all along the middle and some folks had complained that it acted as a dam and didn't allow flood waters to flow through, which led to higher flooding in that area.

I haven’t heard any more about that. Last I heard Livingston sued Ascension over the Laurel Ridge levee extension as well but they ended up halting it for now since AP gave them assurances they’d proceed in a safe manner.

The I-12 barrier really should be modified to allow water to pass through, though. The pictures of that thing during the high water event are pretty damning.

does the over topping of the potato levee destroy the potato levee. So will the river need to drop even more

In years past when the potato levee would go under there would be minimal damage. In 2011 when they opened the Morganza structure the Corp brought in a dredge on a spud barge and dug trenches through the potato levee. They were afraid they would not get the necessary flow over the potato levee to feed the structure.

The forebay drains toward the Morganza structure, the potato levee will be out a long time before the forbay is drained, even when they dug through it.

Would the COE make public any points along the levee that may be compromised? Surely it's not all 100% acceptable? Being nothing they can do about it now, really. What's the law on that shite? Is there an allowable limit of, 'Ehhh, we think we're good, but who the frick really knows'?

River forecast bumped UP to 44.6' from 44.5' and that's with the opening of the Morganza.

I'm not sure how that compares to previous forecasts, though. I haven't kept up with that gauge.

A question...

Can the USACE lower the MS river stage in BR via the # of open boards at the Bonnet Carre?
