well, he is an attorney, and both of you guys are right, he did exactly what every attorney friend that I have has always said to do if you ever find yourself in this unfortunate situation, except he probably shouldn't have even attempted the field test, it's set up for failure, by even a sober, world class gymnast

He was probably drunk, but being drousy in the morning is worse than drinking enough to be around .08.

you can also be charged with DUI for being fatigued, you will eventually win, but the expense and hassle will be almost the same as if you were convicted
