re: M.I.P. In Baton Rouge

I got one in tigerland the night before Fat Tuesday in 2000 when I was in BR visiting a HS friend. Was crossing a parking lot with a 16oz in hand. Cop pulled up and gave me a ticket while his partner poured out about 14oz of Old Milwaukee. They even used some test kit to see if it was indeed alcohol. Last thing they did was hand me back the can to throw away.
My dad told me to call our local DA. I did and he told me to come in. He had gone to LSU. He first bitched me out saying if this had been a DUI he would not be helping at all. Then proceeded to tell me when he was at LSU he made it his goal to drink all the PBR and Budweiser that BR had to offer.
Couple days later I got a cc copy of a letter he mailed to EBR DA. Letter stated I had a clean record and he considered the MIP rude. ...or something similar.
No-shite a week or so later I got a letter from EBR office that said the charges had been dropped and I was welcome back in Baton Rouge anytime.
Yes I know the law is the law but none of us are perfect. And when I am caught breaking the law I gonna do my best to try to get out of it.

they are permanent, they may have some access limited, but they are permanent
Certain governmental agencies still have access, but the general public does not and the individual does not have to disclose the arrest.

Got one during football season. Plead article 894 in court (or whatever it's called). Payed $50 and court cost. Six month unsupervised probation. Goes off my record after a hearing at the end of the six months.
Whatever you do, don't take that pre trial bull crap. Straight money grab.
Ugh. People. No. Do not burn your 894 for an MIP! Save that for your Dee Dub or for when you get busted for transporting a pound of pot into Bossier City.

just saying that an arrest record is a permanent one, regardless of the outcome, and all convictions are permanently on record regardless of expungement or having the record "sealed," it just limits the access to the arrest or conviction, but in today's technology, it just takes a little more digging

Can you do more to explain than just repeating that it's permanent?
ETA: When's the last time you dealt with expungements?

not being a smartass, but what I mean is there will always be a record for an arrest or conviction, it will never be erased, if a deal is made for expungement or for a sealed record, it just means that it may not show up on a perfunctory search, but an in depth search will detect it

What would you search for to find records of MIPs?

isn't an MIP like a ticket? not an arrest?
Posted on 4/11/16 at 4:34 pm to 777Tiger
It's a criminal citation. The judge can sentence you to 6 months in jail. It goes on your arrest record.
What would you search to find a record of that?
ETA: We can expand the discussion if you want to your typical "arrests" (i.e., placed in handcuffs). If the newspaper doesn't report on the arrest, what would you search to find a record of it?

most attorneys can look that up, I do some work with the EAP at my place of employment and they've got a pretty invasive search program that just about reveals if you ever got detention in school, also most cops have that capability in their computer

And they wouldn't hire you because you got an MIP when you were 18 and in college?

To be a pilot
Also, this is 100% not true
It's a fantastic idea to waste an 894 on a stupid MIP

I don't have my last record check on me, but every single thing shows up....even stuff I wasn't charged for, stuff that got dropped, no bill stuff, etc. Everything is on there (except traffic tickets)
You can expunge arrest records

Not if it has been expunged. Read the statute.

100% not true
Stuff you specifically expunged showed up in your criminal history?

Yes. I told you, I know this for a fact. Stuff I wasn't ever charged for shows up also. Everything shows up if you look in the right place
I have done a side-by-side comparison of an "extensive" one that a company pays for and my actual record. The paid for one was clean. The other, not so much
Eta: I believe it is illegal to check someone's actual criminal record, but none of that stuff ever leaves

We had an associate who had a DWI in law school, after Bar was on super secret probation and not allowed to drink. Got piss tested and suspended for about 6 months. Really killed his billable hours.
Anyhow, if not worried about future schooling/profession, just pay the ticket. Otherwise, diversion is the way to go.

Yes.

ETA: Just saw your edit. You are one of the people that get to see your actual record. You, some governmental agencies and school boards if they get permission.
