You cannot give informed consent at a .319 bac.

imagine driving that drunk girl to the police station in her condition and saying "hey guys, look my buddies just railed her in my backseat on the side of the road after leaving the bar but she totally said yes to sex after the 7th time she was asked and woke up from her unconscious state to answer. she's very volatile and rude right now but i'm doing the gentlemen thing by bringing her here so i know she's safe. And please don't look at my phone, i swear i have no acts of video voyeurism on it. "

They could have dropped her off somewhere safe. If they were afraid she would talk they would have done something different. I don’t blame these guys directly for her death. What happened after she got out was not really their fault. BUT I believe they had sex with her without consent, and should be punished accordingly.

Where exactly was she dropped off?
As written it says “Pelican lakes parkway near Burbank”
There a big apartment complex right there.

Let’s all be honest here, if she wasn’t a pretty white girl no one would give a frick and this would have never been a story.

I forget if the driver was sober or not, assuming he was. He could probably explain the situation to the officer, mileage varies depending on the cop.
"she is blackout drunk. I was giving her a ride. she has been belligerent"
that is ignoring the context of what may or may not have happened that night.
Of all the options, letting her out in a fairly dark stretch of Burbank and then driving off is probably the worst of them. At least wait for the uber

But you are saying “regardless of the law common sense prevails” right?
Well, that’s how most people view drunk sex when the person who is drunk wanted to have sex and is happy about it…

Genuine question, is it considered rape if the girl is a willing participant, but drunk? - Yes, consent cannot be legally given.
What if both parties are drunk? - Probably an argument to be had, but let's not pretend drunk dudes are given any leeway in these things.
Is it the responsibility of one to quantify "how drunk" the other is? - No idea

look, from my recollection i think they pulled into a driveway that led to something but they just let her out in the first parking lot that was probably about 50 ft from the road. It was just a pulled over and she got right out type situation. She then walked straight to burbank, crossed the road onto the other side, was so shitfaced that she got hit by a car with headlights.

You care about the color of the girl it's not important to a rape case a-hole

You are right. It’s purposefully written so that rapists can’t say “oh she was only a .16, she wasn’t that drunk” or if someone was blackout drunk and woke up the next day and claimed she was raped and there is no bac.
It was most certainly not written so dudes can repeatedly ask a girl with a .319 who has already passed out to have sex until she says yes.

Man you are arguing with the wrong person here
I ultimately think thee guys do get charged based on Carvers initial testimony. I think it was brain dead dumb though for the DA to charge Carver with rape. That is obviously over reach and now your best potential witness is out against you

I have no clue where they dropped her. But they could have driven back to the bar and at least and things may have been different.
