Sorry I didn’t read the whole thread. You also can’t recover any damages if you were 51% or more at fault.

This law only punished people who pay for their health insurance.

Let’s say 3 people
go to the ER and get a 100k bill.

Person 1 had no insurance. His attorney gets all 100k of that hospital bill paid under this law. He can then go and negotiate the bill down and get his client the windfall

Person 2 has Medicaid. They only get what Medicaid pays and they have to pay medicaid back. But Medicaid is free.

Person 3 pays for Healht Insurance. They only get what their health insurance pays, they have to pay their health insurance back what was paid AND they have to keep paying their HI premiums.

The whole point of Collateral source was adverse drivers shouldn’t get to benefit from arrangements you pay for that lower your own bills.

And we already adjusted this from a full 100% difference down to 40%. We did that 5 years ago and rates have still increased.

this law doesn’t benefit PI attorneys at all.

it only benefits Insurance Companies.
