Does the at-fault insurance have to get you a badass rental car? Or just a piece of crap of their choosing?

Had a ‘74 Firebird Formula 400 with 48 k miles on it. It was totaled after being hit by a kid in a pickup. Rental vehicle provided was a POS Jeep Patriot. It was like driving a tampon.

Well, the other person's insurance isn't giving you shite up front. You can rent a car yourself, and file a claim (or lawsuit) in an effort to be made whole, and in a general sense you are entitled to that money.

If the specific nature of your rental car becomes an issue, that could conceivably fall on a judge to decide. At that point, you're rolling the dice. Personally, if some kid flattened your Ferrari like a can, and you rented a Cadillac instead of a Daewoo, I think I'd just give you the cash.

If you rented a Ferrari, though, I'd probably make you cover the difference between that and the Cadillac. Wrecks happen; it's not up to the rest of the world to feed your midlife crisis. The law has a (subjective, I admit) concept of reason.

Why should my lifestyle suffer because I was hit at no fault of my own? I would not risk the high out of pocket cost of something extra but I sure would not be taking the cheapest rental.

That's a good argument, but I think a good attorney would counter-argue that your lifestyle did not really suffer because you had to temporarily drive a Cadillac instead of a Ferrari. You still got a car easily capable of reaching the legal speed limit quickly, with A/C, a stereo, comfortable seats, lots of cargo area, etcetera.

All you lost was difficult-to-quantify value of overpaying for a luxury good, and in general that value is not a part of "making someone whole."

For example, unless you're a major league pitcher, an injury settlement is probably not going to cover surgery by Dr. James Andrews, particularly if he costs 15 times what Rajesh Patel, MD at STPH costs.
