Once the place is sold, the rental agreement is null and void

Should have cleared that up before the sale

OP is saying 'wear and tear' but we all know what that means from a renters POV.

To flip the ethics angle on the OP, he possibly didn't bring it up until after the sale/price was locked in so the seller wouldn't have negotiated.

That should have been resolved in the closing statement. Just like property taxes and insurance is prorated.

To clear things up.

I am not bitching about $1000 I am asking if it is rightfully something to expect back (he actually agreed to refund it if I felt deceived).

I am asking about the ethics part of it. Through my employer i have a real estate lawyer that looked at the purchase contract and lease and said it was something to be returned.

I sure as hell don't want to find myself on the wrong side of a situation like this in the future. Like I said, if I had sold to my tenants, I personally wouldn't think I had a claim to hang onto a security deposit that I didn't have to repair the unit.

Christ no i am not. It is already resolved what the prorated rent back to me will be.

Ethically, you shouldn't give a shite. He gave you a deal. You let him keep the $1000. Everybody should be happy. That's the right thing to do.

Legally, maybe he owes you. Don't act like you're thinking about the ethics of it when you had a lawyer looking at the agreements. Ethics aren't in the legal documents

Usually the deposit is the same as the rent. For $1000 a month, is it at least a nice doublewide?

Sounds like the seller is a good person and this situation is now in your hands.

I think the "as-is" condition is what lead to a price at below market. In a sense, you are wanting to be compensated for the condition of the house in the form of a reduced price, AND be reimbursed for a security deposit that likely would have been withheld if this was a normal renter/landlord scenario.

You'd kind of be double dipping in a sense.
