Many states have statutes to protect tenants from getting screwed out of deposits. You may be required to make written demand and allow so much time, after which they have to return the deposit or provide a detailed list of damages to justify holding it. If they don’t, you can sue and get not only the deposit back but also a penalty and attorney fees. Google a bit, and you can likely find the law in your state.
A buddy did this. The apt complex did not reply to his letter, he sued them in small claims court, and ended up with a check for more than double his deposit, Your mileage may vary.

The 1k is peanuts in a deal this size and i realize that. I certainly think wear and tear would cause loss of the deposit if I had moved out. This is more of a curiosity to me because of the murkiness of an "as-is" offer he made to me with no mention of the forfeiture of the deposit.
The responses of "its only 1k" were useless. If it had been 2k (which is 1 month rent) would things start changing then? 3k? 4k?
It all goes back to the initial question of would you expect that money back in a situation like this?

I have bought $750,000 pieces of equipment and I can assure you $1000 is not peanuts when negotiating a deal.

Very true. I am not trivializing it. I have $1000 in repairs I would love to use it for.
This is just a weird situation which is why I wanted to hear opinions.
