Hypothetical: spinoff of dude kills intruder in shower

Let's say it's a cold night with temps below freezing. A man's car breaks down in the middle of nowhere. He has a cellphone but no service.
After a few hours of getting really cold, he gets out of the car and starts walking. He sees a lonely house up ahead and knocks, but nobody answers. Seeing lights on and deciding the house has heat, he slips around to the back and finds a window unlocked, slips in, and walks into the living room.
There the homeowner with his wife and small child is sitting with headphones all, playing a game. The homeowner is scared stiff to see a strange man walk into his living room; he reaches into a drawer and pulls out a handgun, points it at the man, and tells him to get out immediately.
The man starts trying to explain his situation, but the homeowner quickly cuts him off, repeating to get out before he shoots. The stranded man is now fearing for his life, but does not wish to go back out into the frigid night with no hope for rescue or another house nearby. He picks up his phone, starts recording video, and then starts yelling "I'm unarmed, I'm not a threat, I just want to be warm! I'm recording this to prove I'm no threat"
After about 30 seconds of the homeowner yelling for the man to leave, with the stranger yelling in return "I'm not a threat, I'm unarmed, but I'm not leaving", the homeowner opens fire and kills the man. The homeowner then calls the police.
What should happen the homeowner? What would happen in say Tennessee vs New York?

Why not just be honest? Homeowner might have some compassion if he knows the situation.
If some dude pulled something out of his pocket after breaking into my house, I'd probably pull the trigger.

Nothing.
It doesn't matter why the guy did it. He broke into the guys house and ignored repeated warnings to leave. The homeowner gets to defend his house and family.

The man clearly said he was unarmed and not a threat. Criminals don't lie and this man is clearly a criminal, having broken into your home.
Most people would not give him another breath once he started digging in his pockets so there would be no recording.
