The DA's office is asking for estimates or other documentation to support claim of dimunition of value. I have spoken to my car dealer about this and he says that he normally would deduct 2-3K off a car with a hit on carfax like this.
He would not put this in writing though.

Where would I go to get some documentation to support my claim.

I was recently rearended and had to get minor body work. The guy at the body shop told me that it's the insurance company that reports accidents to carfax and that the insurance companies have to pay carfax. Because of this, the companies do not always report the incident to carfax. Upside: your accident might not show up on carfax. Downside: you might one day buy a car w a clean carfax and it has actually had accidents. I had always thought the responding LE reported to carfax.

I purchased a 2015 at the end of September. Looked at about 15 others and got the carfax on all. It was amazing seeing the details those things provided. Every single oil change was documented in some of the vehicles, air filters, tires, etc...

Seems like once they entered the VIN # into a system for maintenance it was on the car fax report.

When I traded in my last car I let the dealership deal with that, they have access to the VIN number and can pull it if they want. I got a fair price for trade in so I left it at that.

I'm getting ready to file in small claims court over this very thing. New 4runner with less than 20k miles. 4500 worth of damage, they offered 750 in diminished value.

The difference in trade in from good condition (non wreck) to fair (wrecked) trade in is 2200 dollars. Thats what I asked for and they said no.

I told them I'd take them to small claims court and they said no problem. I'll get my 2200 and it will cost them legal fees. No problem...

I spoke to several people today and the concensus was that the wreck would reduce my cars value between 2500-3000$ when ever I decide to sell.

I plug some figures into Carfax and came out with similar numbers. Since my car is low mileage, it would be on the higher end of the range.

I plan on submitting this to the DA's office and see where it goes. I know the insurance company of the person that hit me would tell me to pound sand, so lets just see how bad this dude wants to not have to go to court.

depends on the value of the car obviously.

You should have sued their insurance company for loss of value in addition to the damages.
