No! Choked yes, to death no. The guy was yelling that he can't breath. If you can yell, you can breath.
Yea, the fatal asthma attack moments later was just pure coincidence

True and the correct answer.
If the officer hadn't used illegal force (by NYPD standards) for a nonviolent criminal who was selling frickign cigarettes, the guy would still be alive. Perhaps you'd care to move to another society where people can be killed for such trivial acts. May I suggest Iran?

least the cop didnt shoot

Look up the difference between a choke hold and a head lock.

From everything I've read, chokeholds are not permissible police force (at least according to NYPD regulations).
Choke holds are illegal. Takedown holds are legal. The vid doesn't have an angle to be sure.
The amount of time between engagement and officer releasing is nowhere close to long enough to choke to death. Look at the evidence before condemning people. Many made this mistake on M.B.

So why no indictment??

This situation merited neither. It merited a ticket or a citation. Instead we got a crack squad of over eager cops treating this like they were breaking up a drug deal. Which starts with the city government.

Incorrect. He must be arrested according to local law. It was a sting just for that purpose. As I said before, blame the tax hungry city.

I edited my post, so you may have typed this before you saw my edit, but yea, it was a law - a stupid one which should never have existed. I doubt they needed to take him to the ground at all, though.

NYC really,, really sucks when it comes to these things.

I saw the change too late. I can only point out that your last sentence is not correct according to the very reason they were sent there. It was a sting operation. They HAD to make an arrest. I can only question chokehold vs takedown. The vid appears to indicate takedown which is quicker but less fatal than chokehold. Coroner says chokehold. If grand jury believed coroner there would have been an indictment.
A sad outcome due to a tax hungry city.

I hate that place.

What's being lost in this shuffle is how absurd the law is to begin with - the law that requires arresting someone selling loose cigarettes rather than issuing citations or tickets. That's NYC for you these days.
Honestly, the way the master settlement agreement is set up, you can't just issue citations. It could cost the states hundreds of millions.

How would you have gotten him into custody?

Not tackled him and put him in a headlock? Have you not seen cops grab someone and turn them against a wall?

So how would you have gotten him against a wall? It's hard to just turn someone around, much less a guy that size. It's why officers are trained to take a resisting subject to the ground. It's the best way to gain control. The method they used to get him to the ground is questionable and against their department's policy, but taking him to the ground is standard procedure for subjects that do not comply and/or resist arrest.

I'm sure the fact that he was 350 lbs had nothing to do with his death

Only fat people can have severe asthma? Who knew?!

Yea, all 350 lbs decided to die the very second a cop had a grip on his throat. Must have been those calories' fault.
