This is such BS. Because Heaven forbid we put some personal responsibility on the 26 year old adult here.

Does the "but for" defense work here? As in he would be alive today but for his actions starting and continuing a fight?

What gets me is Marsiglia was arrested for manslaughter.

And he didn’t even punch him. He just pushed him after the other guy threw a punch; basically passively defending himself. That’s bullshite

What 26 year old is having their bachelor party going to Fred’s?

and if the vaunted BRPD isn't standing right there, then what?

Did the fight and death occur in their parking lot, which is probably their property? I honestly don’t know. If it did then, Fred’s needs to come up with a solution. An attorney could easily and successfully arguing court that the owner of Fred’s is aware (or reasonably should have been aware ) that drunks are prone to fighting in their bar and on their property.

Maybe it's the "off the premises" language, I'm not sure.

Does "Fred's" (or whatever LLC is set up I assume) own the parking lot or do they just rent their space in the building?

There's another bar attached right? Was Reggie's back in my day if I'm remembering correctly.

If this goes anywhere based on the parking lot being part of the premises you'll probably see the property owner setting up an LLC real soon to rent the space to Fred's.. even if it's the same ownership.

Nope, just like your response about liberals did not change my opinion of your post.

It shows that you ignored the major premise of my post

The new contributory negligence law that just passed will likely cut down on these types of suits.

Why should the bar be responsible for two patrons fighting? That's a clown take

Don’t be so sure of the sizable insurance policy.
A&B endorsements are expensive and sometimes rare for bars or certain types of bars like Fred’s.
Baby momma will get SS survivor benefits for the kids though.

Who owns/leases the bar/building?
Who owns/leases the property?
Who holds the liability insurance policy and who is named and waived?

This will be played out in a court of law. Not a message board. Like I said, it will be argued in court that if it occurred on their property, the owner knew or should have known that drunks are prone to violent fights on their property.

To be clear. I believe the dead drunk bears responsibility for his actions. A jury might decide that the owner of Fred is responsible for X percent,

I already said why three times. Hint, it’s in part of the posts that you continually ignore.

You are saying they are responsible. I'm asking you why two morons fighting should be their responsibility. All you've essentially said is "because" with no actual reasoning.
