FFL gun transfer question.

Buying the gun from Buds online and being shipped to an FFL. Will it matter if the name on the billing adress / payment is different than the person who is actually receiving the transfer ?

That's a really dumb question.

And yes. All names must match or it is considered a straw purchase
ETA: At least that is what the gun shop near my house told me

no, you should be good. when i do transfers, i dont even see the order sheet. itd be like someone buying you a gift gun and telling you to go pick it up. just make sure your license and shite is current

Well it was supposed to be a gift and was just gonna get paid for and I would go do the background check and take the transfer. Never done this before.

Tell the guys over at Arms Merchant in Mandeville to give correct info to their prospective customers then

So Carson is right ? I know he works for Bowies. But this isn't something I want to just do and cause a big snafu without being sure.

make sure you explain the circumstances when placing the order and contacting your chosen transferor.
specify who will pick up the gun and when you call your transferor to request that they send their FFL, specify for them to include FOR: John Q Smith with the order number when they fax/email it in. Inform Bud's as well. it always sounds sketchy if you don't say it's a gift, so I'd say it was a gift if I were you
we've done gift orders before with no issue. just have to prepare ahead. speak with the place at which you'd like to do the transfer in advance. they're the ones who have the final call and they could refuse to do the transfer (which would be an error)
bottom line: plan ahead. make sure it's okay with the FFL. it is legal though

Thank you sir. Called Bowies today to see if they had this particular pistol but no dice.
But anyways, paid for it myself. They can gift me the money later. Will be easier most likely.

yeah bro, my bad. we dont carry much FN in-house because they just don't move for us. we usually special order em and get em in a day or two. ordered an FNS-L last week

Carson - correct me if I'm wrong - but the problem occurs when the person on the 4473 and who takes possession isn't the ultimate "purchaser" of the gun.
4 scenarios:
A. I'm buying the gun for me. I fill out the 4473 and I pay for, receive the gun.
B. I'm buying the gun as a gift for someone else. I fill out the 4473, pay for and receive the gun. I transfer the gun to the giftee at a later time.
C. Someone is buying the gun for me - they pay for it and I fill out the 4473 and receive the gun.
D. I'm buying the gun on someone else's behalf. They are the ultimate purchaser, but I fill out the 4473 and take possession of the gun.
Only D. is considered a straw purchase according to the FFL, unless I'm mistaken.
I think B. is only a problem if it is known (or, lawyer talk, reasonably should be known) that the giftee is ineligible to possess a gun - and I think that's only a problem for the person making the gift, not the FFL.

Yeah Jim's is the only place in town that had one. Wanted to handle it. When I called everybody else and they didn't have it either, I told the person that Buds would be best. I like employees at Jims, always been helpful. But high as giraffe pussy on everything.
