My bad. I misread what you had said. I was thinking you were saying before the guy had the bat...not the actual act of throwing it.

the bat is not on video, the video does pan back up to him throwing that bat after he was shot.... what the video doesn shoe is what is the dead guy doing with the bat before the shot....

Looking at the witness statement, he was trying to swing the bat at the guy....

So back to the case, it is crazy the decision is split..

Irrelevant. Fatdad had his finger on the trigger before the dead guy was ever armed. You don't get to start the confrontation with a weapon against an unarmed guy that is outnumbered and then claim self defense. Especially when you shoot first.

Right, it's hard to know exactly what happened since it's only partially caught on video. But it seems like guns were used once he had the bat in his hands (based on shots and the bat throw being so close together), then I guess the son walks because he didn't shoot until after the hat was thrown (better self defense evidence maybe?).

I honestly thought that if anybody would be guilty it would be the son, but I had that arse backwards. But again, after shots were fired we didn't see anything really, so we don't know if the son's shot was egregious or necessary (from a self defense standpoint).

Thank you. I rather not live in a society where this type of behavior is acceptable. Self defense shouldn't be you can intimidate and encourage an emotionally unstable person into giving you a reason to end their life.

I guess convicting one was some sort of conflicted happy medium. I'll take that over no consequence at all.

Yeah my thought was the guy began to swing at dad, who began shooting, he threw the bat, hence then unarmed and son shot him. The proximity is hard to tell but looks close enough to be a viable threat? Maybe it was found to be farther. Also maybe the time element for the son shooting was deemed close enough to be the same series of actions, i.e., didn’t have time to stop and assess.
We’ll see what happens on appeal. Juries can obviously be guided by all kinds of things.
