Imagine buying an insurance policy for your home and it burned down and when you submit the claim they tell you that it’s not covered because some random dude started a fire a half a mile away!

I don't quite understand you post. Subrogation means that you are assigning your right of legal action to another party, in this case your insurance company. It is your policy that makes you whole, not the offending party.
If you sue them for your unrecovered losses, then the courts will rule on the merit of your suite. Are you saying that you lost your suite, because the courts ruled that the offending party had no liability due to the fact that the fire was ruled arson?
