You really think a person who can afford a $100k vehicle wants to deal with the issues of a flooded vehicle? They want the full amount of the settlement to go buy another $100k vehicle.

That only applies if the insurance company acquires ownership. It is not the same thing as a salvage title.

you cannot buy it from the insurance company. Unless you have a salvage type license (this is all from Katrina memory)


IIRC ins companies sell these cars to mechanics who refurbish and resell with a "salvage" title. You'd have to find a specfic mechanic etc to even start I think

Maybe, maybe not. It varies from vehicle to vehicle. If you have something rare and/or valuable there is no reason to allow the insurance company to buy from you.

My little porsche is a good example. While not an exceedingly rare or valuable when compared to other 993's, it didn't make sense when it flooded to scrap the car. Replacement cost would be 2 or 3 times the insured amount. People with $100k cars don't have 10/20/10, or whatever state minimum is, so it's apples and oranges.


Edit- I've never tried this but if you have a valuable or rare vehicle that flooded, can you file a claim with your insurance without them taking title to the car? Could you opt for a lesser payout and a salvage title?

Because if you have liability only, you don't get a penny from the flood. Ergo, you could hose it out and sell it with a clear title.

Isn't that what we're discussing here? OP has a car. It flooded. Insurance totaled it and bought the car. OP wishes to buyback the car. Insurance company can't sell it because they're required to get a Certificate for Destruction for it.

I also understood that your car and the other poster's car fell under the same scenario, namely that it flooded and the owner's insurance deemed it a total loss and bought it.

The two are not mutually exclusive. They can declare it a total loss without buying it from you.

Gotcha. OP's car has been bought and is going to be destroyed. In your case, the insurance company didn't buy your car?

What you guys are missing here is that a state of emergency has been declared. When it's declared, that's when flooded vehicles cannot be kept according to the law.

You drive it in a ditch and flood it out randomly, you can keep it.
