I never admitted to taking anything that day, they found my Rx bottles and assumed. They were even nice enough to put my scripts in my property so I could sleep nice in jail.

I see that clearly; now it’s a matter of fighting it and keeping it off my record. And if I got COVID in that fricking jail and win this I’m suing that county for every cent they have. Even LA isn’t locking up legitimate drunk drivers right now because of COVID.

That was all after the arrest so it wouldn’t have changed their line of investigation. I didn’t consent to a search before the arrest.

Did you go get an independent drug test when you were released?
I remember a case in st tammany where they arrested an old lady, charged her with dui because officer said he could just tell she was under the effect of drugs or narcotics. She blew a 0.00 on the breathalyzer. So he arrested her because he said he was "trained and could tell" she was under the influence.
She went straight to the hospital when released and got a drug test and was 100% clean. She fought it and won.

I haven't been giving legal advice as we don't have an attorney/client relationship and do not have one now, but if you are thinking of fighting I would definitely change this thread to a hypothetical because everything you have said, while perhaps helpful to your cause, is admissible in court and should you every be deposed and recount differently you will have a challenge on your hands.

Had it been booked into evidence then it would be evidence admissible in court. They put it in my personal property so as far as the law is concerned it doesn’t exist.

You may be correct, but that’s kind of unbelievable considering how seriously this state takes drunk driving these days.
