it's sad that you don't understand he wasn't vindicated or exonerated. Nobody with a brain is saying he's not guilty. They're just saying they're crappy legal system can't handle the case any longer. At the very least, the man was negligent. He was responsible for her well being and failed her.

No, they're saying they had insufficient evidence to convict him of any crime.

No one, regardless of how guilty they appear, should be imprisoned based on false testimony.

No one is disputing that.

This would suck

Could have ducked even worse. He could have been in general population instead of death row.

Kern County is basically Nifong territory. There was a case a few years ago where the cops falsified an interview transcript to include a confession that never happened.

The threshold for the death penalty is pretty high, but it really should be higher. It should require irrefutable DNA or video evidence IMO. Something along those lines.

'm sure he was guilty of something else anyway.

If they would have just killed him and not wasted our tax money on appeals and keeping him alive, this wouldn't be an issue.

Nothing screams America, freedom, and small govt conservative like arbitrary and severe punishment for unproven claims.

Y’all realize that the pos killed that child, right? Y’all realize that they’re not saying he didn’t do it?

A forensic pathologist concluded that the girl died from injuries idicative of being sodomized, and several doctors testified that the girl's injuries were caused by sexual assault. But nearly all later recanted, saying they hadn't seen her full medical records that indicated there was no evidence of sexual assault when the girl was first hospitalized. They also said her genital and other injuries may have been caused by her medical treatment and some said the purported cause of death was "anatomically impossible," according to the state Supreme Court's ruling.

They should replace him on death row with those doctors.

What do you do at 68 years old after serving 25 years on death row?

The fact that he's still exchanging gases is a miracle.

This is why we don't just take people out back and shoot them like some geniuses on this board always want to do.

Well he was on death row. I think they’re pretty isolated from gen pop.

Agree. I was sarcastically making the "arguments" that the blood thirsty death penalty proponents constantly make here. I am against the death penalty.

Infidel is very level headed and thoughtful. As you can see, he has determined that this "POS" did it. So that should be good enough for you.

I completely agree. It's just not clear cut this guy is innocent and has been wrongfully imprisoned, that's all.

Well there is this whole presumption of innocence thing in America. If the state can not prove guilt, then you are innocent, which in this case, equals wrongful imprisonment. The prosecutor was quoted in the article as saying she couldn't prove even a lesser included without the false testimony.

He will probably have a pretty good civil suit if this evidence was knowingly wrong when given.
