California inmate released after 25 years on death row

The Innocence Project, which helped secure Benavides' freedom, tweeted a photo of him and one of his attorneys posing along San Quentin's Main Street shortly after his release.

Footage by local TV stations showed a tearful Benavides reuniting with and hugging family members and posing for selfies.

Kern County District Attorney Lisa Green said earlier this week that she wouldn't retry Benavides for first-degree murder and that without the medical testimony, a lesser conviction would be nearly impossible.

"Upon an objective review of the facts, there is insufficient evidence to establish guilt beyond a reasonable doubt," she said in a statement.

Benavides told police that he had lost track of the girl and later found her injured outdoors. He and the girl's mother took her to an emergency room and she died a week later.

But nearly all later recanted, saying they hadn't seen her full medical records that indicated there was no evidence of sexual assault when the girl was first hospitalized.

They also said her genital and other injuries may have been caused by her medical treatment and some said the purported cause of death was "anatomically impossible," according to the state Supreme Court's ruling.

One expert on child abuse said the girl likely had been hit by a car, not sexually assaulted.


On the strength of this a man is sentenced to death?

Sad all around but vindication at the end.

What should a payout to someone like him be anyway? His whole life is rekt.

Sadely, he won't get much of anything. Besides he's 68. NOTHING can buy back those 25 years, IMHO

I'm sure he was guilty of something else anyway.

If they would have just killed him and not wasted our tax money on appeals and keeping him alive, this wouldn't be an issue.

I think I read that on another similar type of case that they were given the wrongfully convicted person 50k/year x X years. Paltry considering what he lost, but at least he'll never have to worry about money......unless he becomes a drug addict.

What would you do if you were in prison for 25 years and pretty much all your family is out of your life (or dead)? Build a house? Go live in a foreign country? I'm not sure what I would do.

It's not much, there is a monetary number.. like $15k a year I think?

Even if he has some money coming to him, he more than likely won't know how to manage it, much less have the social skills for getting along in 2018. What's a cellphone? How do you order something online? His best bet is to check into some assisted living facility where someone will take care of all that.

Even if they convicted him of wrongful death or something like that. He would most likely get time served. It's not worth the state's time and resources.

Also, you never hear about the AG or their team getting into trouble for falsifying documents or misleading the defense or even hiding documents.

A lady I know very well argued infront of the SC last year about a similar type of case where the prosecutors office withheld a bunch of info (she was one the prosecutors team as Assistant DA) and then was on the defense side for the SC argument. NOTHING happened to the guy who withheld info; That is a travesty in itself.

Good point. You'd almost have to baby him for money management. REminds me of NFL players who blow their load right away and don't save for shite.
