They certainly do. However an impaired driver shouldn’t even be on the road. By driving at a .08 he is breaking the law. Therefore just his presence on the road is a contributing factor.

Doctor will likely now face a civil lawsuit where the plaintiffs family will sue him for punitive damages due to his alleged intoxication.

Even though he didn't directly cause the accident he was engaged in an illegal activity.
Plus had he not been intoxicated (even slightly) he might have been able to swerve to avoid impact.
