I have CLEARLY stated now 10 times that I am talking about the situation the OP described ONLY and if that other factors were involved things change, you and others are as usual just too stupid to understand.

If under ANY circumstances, a driver pulls off a minor road onto a major road RIGHT IN FRONT OF another vehicle causing an accident, that driver is at fault, doesn't matter how fast the other driver was going. Comparative fault doesn't mean if someone pulls out right in front of you but you were doing 40 in a 30 you share part of the blame.

You're just a dumb motherfricker who thinks he knows it all and doesn't even bother to read what others write. In the situation the OP described speeding by the other driver would be irrelevant. The guy pulled out right in front of him. Totally different than if the guy pulled out and drove down the road even 50 feet and then got hit from behind because the other driver was speeding and couldn't slow down in time.

Now, tell us Mingo how many of those triple stackers did you have at McDonalds this morning?

This is, of course, the case if no witnesses.

Dash cam bro. I have one. I should get more for different angles though. If you live in the south you need to protect yourself from undesirables.

A friend got rear ended and was at fault for pulling into traffic.

I don't have all the facts. But that's what the insurances went with too.
