Fast forward to this morning and now we have to lay off a long time employee who was instrumental to the firm's growth and success. Really sharp guy. He is 52 years old. They want him gone before new guy gets here.

I'll bet the company is owned by a Private Equity firm?

I've been asked to do this before. A company bought the previous one, and with it comes new rules and methods. I enforced the rules hardcore and the old employees finally left. Sucks but oh well. She was 58 and I was 30 at the time.

That's the fricked up part. I left IBM because of a shitty culture and up until recently this new company has been the tits. Great focus on work-life balance. Benefits were better than anywhere I've been. We merged with another company and expanded into new markets, so some of the executives are new (to me.)

I honestly just think it's the new COO. I started working on my resume last month because I want to move. Looks like the process may be getting accelerated.

Oh this thread is going to be great evidence in the employment lawsuit that's going to get filed.

That would be awesome. I haven't talked to the target yet but I would testify on his behalf in a heartbeat.

you should anonymously let this older employee know about why he was let go. then take a few bucks when he wins the lawsuit

Yeah, you can't do this.

And you are next.

The company will easily lose the lawsuit over this. Very easy to prove and they will have no defense.

Upper management will play dumb and leave him holding the bag.

I'll not comment on the "what should I do", because you'll do what management says. I will wait for the "age discrimination law suit that you'll get blamed for" thread. If you tell them, "all these guys that were interviewed are shitty, I will not hire them", what can they do to you?

HR timeline is pretty easy to follow on this. Hire employee A, and laid off employee B.

Nah. If you want to make money off of this, you should get it from the company. We've already discussed it here and decided it was both legal and ethical.

How so? I'm being honest and as ethical as possible. I wouldn't mind taking a demotion and going back into the trenches where I belong.

Anyone need a .net/C#/Java developer?

I remember when I was fired awhile ago. That was one of the toughest times me and my family have ever went through. Bless your heart.

Make sure you have in writing that you are instructed to do this so you aren't the scapegoat in the lawsuit.

Oh, you think "WWTOTD?" is a solicitation for advice? Hardly. It's a mere curiosity.

If I were looking for advice or a code to live by I would ask WWCD. What would chicken do?
