A disclaimer is not a legal agreement. I can't open a hamburger joint and put a disclaimer that says I'm not responsible for machine malfunctions then claim no liability when a customer finds metal shavings in the meat.
It's not reasonable to lose $43m on a penny slot due to a glitch but a steak dinner is probably not reasonable to most in that scenario.
If the casino and gaming board could show that they give refunds when the machines error in their favor then they'd have a lock shut case.
I don't know if the legislature has done something special for the casinos to absolve them of liability but it's not unheard of for special interests to get such special treatment. If there's no special tort protections then they will probably lose 4 or 5 figures in civil court.
