It's very easy for them to upgrade charges. A smart prosecutor avoids over-charging in cases that are likely going to trial. That's why Casey Anthony is a free woman today.

Death penalty is hard to obtain, expensive, and never seems to be carried out anyway. Just get the 2nd deg conviction which is life without parole and be done with it.
