On the civil side you take the plaintiff as you find him, preexisting conditions and all. My guess is it could go to mitigation but she absolutely could get convicted of 2nd degree depending on the facts.

It's ashame people have to mind their own business no matter what for fear of these kinds of things happening. There just isn't any respect in general anymore. When I got caught and yelled at for being an idiot by someone, I stopped and accepted the fact they were right...now its like "oh no you didn't" and all hell breaks out. Sad.

So they only beat him over the head to give him a headache for telling them not to litter. I guess he should of told the trio he had a pre existing illness, brain tumor, and please only break my nose or something else so I don't die over it. This is why I cannot stand how the law works. Probably only one will get life, the other two 5 years. Because the lawyer will argue which blow actually killed the guy. Dindu nuffins.

And she could walk free if the DA goes that route, no? My guess is the charge is trumped up to get her to plead to the lesser manslaughter charge without having to go to trial. Without knowing the specific details of the incident as yet, it's likely going to be difficult to prove she intended to cause the man's death. That's where his pre-existing condition works against the second degree charge.

Mitigation meaning she gets convicted then they look at his condition prior to sentencing.
Need a criminal guy to tell us but I dont think she gets a break because of his condition.

Irrational doesn't necessarily equal murderous, which is why you have charges such as manslaughter.
Looking at the LA statute, second degree murder seems reserved for instances of premeditation and/or additional aggravating circumstances (drug deal, robbery, etc.) that placed a person in a likely position to commit murder.
She probably meant to harm the guy, but I doubt she intended to kill him on that day.
That's not trying to defend the girl's actions. I'm just explaining why I don't think she'll get second degree murder in the eyes of the law.

The DA is going to have an uphill battle if he's planning to charge a chick chilling on a river one minute and then knocking a guy over the head with a bottle during a sudden argument the next minute with second degree.
